Terms and Conditions hero — Ealing Business

Terms and conditions

The rules for using Ealing Business and holding a membership.

1. Who these terms are with

These terms are between you and Theo Ruby, a sole trader trading as Theo Ruby Marketing, of Elthorne Avenue, London W7 2JN, who runs Ealing Business (“we”, “us”). By creating an account, adding a listing or posting anything on the site, you accept these terms and our community guidelines, which form part of them. You must be 18 or over and authorised to act for the business you list.

2. Your account

You need an account to add a listing or post on the site. Keep your password to yourself, and tell us if you think someone else has access to your account. You are responsible for what happens under your account. One account per business, and the details you give us must be accurate. We may decline a registration, or merge duplicate accounts, if a business is outside our area (the postcodes listed in our community guidelines), cannot be verified, or the sign-up appears to be automated.

3. Your listing and what you post

You keep ownership of everything you post on the site, including your listing, events, offers, Skills Marketplace posts, testimonials and images. You give us a non-exclusive, royalty-free licence to publish it on the site and on our partner site, Chiswick Business, and to use it in reasonable promotion of the site and its members, such as our newsletter and social media. The licence ends when you remove the content or close your account, apart from promotion already published.

You confirm that you have the right to use everything you upload, and that what you post describes a real business you are authorised to represent, is accurate, and follows our community guidelines.

Some listings were added by us from public information, so the directory was useful from the start. If one of them is for your business, you can claim it through the “Is this your business?” link on the listing. Once we have checked that you are connected with the business, it becomes yours to edit, and these terms apply to it as to any listing you added yourself. If you would rather it was corrected or removed, contact us and we will do that.

4. Community guidelines, moderation and reporting

Ealing Business is a curated community, not an open noticeboard. We decide whether to accept a business into the directory, and whether to publish an event, offer, Skills Marketplace post, testimonial, image or link. Membership benefits such as posting events or offers let you submit that content; we will not turn down content that meets these terms and our guidelines without a good reason.

Once something is on the site, we can edit, hold for review, unpublish or delete it, and we can restrict, suspend, close or delete an account, where we reasonably believe that:

  • it breaks these terms or our community guidelines;
  • it is spam, misleading or unlawful, or links to anything harmful, deceptive or malicious;
  • the business is outside our area or the purpose of the site; or
  • it puts our members, the site or its reputation at risk.

We will normally tell you why and give you a chance to put it right. If something is spam, fraudulent, malicious or unlawful, we may act straight away and without notice. We may hide content while we look into it, remove external links or mark them so search engines do not follow them, and block email addresses, domains or internet addresses used for spam or abuse.

We do not check everything posted on the site, and publishing something is not an endorsement of it.

Anyone can report content they believe is illegal, harmful or against our guidelines by emailing [email protected] or using our contact page. We swiftly remove content we judge to be illegal once we are aware of it. If we remove something of yours, or restrict or close your account, and you think we got it wrong, contact us and we will review the decision and tell you the outcome.

5. Membership and payment

The basic listing is free. Paid tiers are billed monthly or yearly in advance by card through Stripe, at the prices shown on the membership page. Prices include VAT where applicable.

Paid memberships renew automatically at the end of each period unless you cancel. You can cancel at any time from your account, and your paid features stay active until the end of the period you have already paid for. After that the listing reverts to the free tier rather than disappearing.

If we change prices we will give existing members at least 30 days’ notice before it affects a renewal.

6. Refunds

If you cancel a paid membership within 14 days of paying, tell us through the contact page and we will refund that payment in full. After 14 days, payments are not refunded, except as set out in section 10. You can still cancel at any time and keep your paid benefits until the end of the period you have already paid for. This does not affect your statutory rights.

7. Events

Verified and Spotlight members can send us their events for the calendar. We also list events we run, events from our partner site Chiswick Business, and other events we think local businesses will find useful. We check every event before it appears, and we decide how it is described and how long it is shown. We may decline an event that is not relevant to local businesses, is mainly a sales pitch, cannot be verified, or breaks our community guidelines.

Where an event is run by a member or anyone else, your booking is with the organiser, not with us. Ticket prices, cancellations and refunds are the organiser’s responsibility, and where you book through another platform, that platform’s terms apply.

8. Member offers and Skills Marketplace

Member offers and Skills Marketplace posts are for genuine offers and requests between local businesses. We may decline, edit, hold or remove posts, and pause your ability to post or reply if these features are misused. Replies sent through the site are passed on by email and must not be used for unsolicited sales messages.

Any arrangement made through these features is between the members involved. We are not part of it, we do not vet the work, and we do not handle payment.

9. What we do and do not promise

We work to keep the site available and accurate, but we do not guarantee uninterrupted access, a particular number of enquiries, or any specific business result from being listed. Listing on the directory is not an endorsement of any business, and our checks do not mean we have verified a business, event, offer or testimonial. We are not party to any arrangement you make with another member. Please make your own checks before engaging anyone you find here.

Nothing in these terms limits our liability for death or personal injury caused by negligence, or for fraud.

10. Ending an account

You can close your account at any time by asking us through the contact page.

We can suspend, close or delete an account as set out in section 4. If we close a paid membership because of spam, fraud, or a serious or repeated breach of these terms, no refund is due for the rest of the period. If we close it for any other reason, we will refund the unused part of the period you have paid for.

When an account is closed, we remove your listing and posts from the site. We keep some records afterwards, as explained in our privacy policy.

11. Changes and governing law

We may update these terms, for example when we add a feature or the law changes. We will email members about significant changes before they take effect. These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
